Joe Rose is a labor, employment, real estate, and civil mediator, neutral evaluator, and factfinder based in Los Angeles and Sacramento, serving clients throughout California. An AV® Preeminent™ and Super Lawyers® rated attorney with over two decades of civil litigation experience, Joe brings both legal expertise and practical insight to every case. As a skilled litigator who has represented plaintiffs and defendants in state and federal courts, mediation, and arbitration, he uses a balanced mix of evaluative and facilitative methods with a determination to help parties resolve disputes privately, efficiently, fairly, pragmatically and on their own terms.
What Is Mediation?
Mediation is a voluntary, confidential process where a neutral third party helps people resolve disputes outside of court without taking sides. It empowers the parties—not a judge, arbitrator, or jury—to shape the outcome. Mediation can lead to faster, more cost-effective, and mutually agreeable solutions that reduce risk and restore stability and predictability. Parties often agree in their contracts to mediate any disputes before pursuing more adversarial approaches, and courts routinely direct parties to attempt mediation before trial.
Evaluative Method
The evaluative approach to mediation involves a neutral who helps the parties explore and assess in a confidential environment the strengths and weaknesses of their positions. Joe Rose provides candid, informed feedback grounded in decades of legal experience representing plaintiffs and defendants to help disputants understand risks, probable outcomes, and make strategic decisions about settlement, blending fascilitatative solutions as appropriate to each problem.
Fascilitative Method
The facilitative method in mediation focuses on guiding conversation, identifying individual and overlapping interests, and encouraging constructive dialogue. Rather than focusing entierely on legal positions, the mediator helps parties clarify broader objectives, explore pragmatic options, and develop their own solutions. This often involves reimagining what “winning” or “losing” looks like in a dispute. Joe Rose blends fascilitative and evalutive methods as appropriate to each unique dispute.
Confidentiality and Privacy
Confidentiality is a cornerstone of mediation. Communications during the process are broadly considered private and protected under state and federal law. Joe Rose ensures a safe environment where parties can speak openly, knowing that what’s shared in mediation stays in mediation unless disclosure is mutually agreed upon. As a condition of mediation, the participants agree Joe Rose can never be called as a witness for or against any party in the litigation.
Professional Fees
Mediation fees are based on a flat half-day or full-day rate including preparation time and reasonable follow-up, with no surprise billings. Rates vary depending on case type, number of parties, and complexity. Parties often share the mediation fee equally. Investigative fees are billed by the hour. Before agreeing to mediate in any dispute, Joe Rose conducts a check for conflicts of interest as required by ethical rules. Contact us for our current fee schedule.
Videoconferencing & Online Portal
Mediations and investigations are available via secure, private videoconference using encrypted platforms. Whether you’re in Los Angeles, Sacramento, or elsewhere in California, we ensure accessibility, privacy, and convenience without compromising the quality and confidentiality of the process. Joe Rose offers a secure online platform where parties can upload electronically their relevant documents, briefs, and exhibits in preparation for mediation.
